These Terms of Use (“Terms”) govern your use of the HerpClutch mobile application (“HerpClutch” or the “App”).

Developer / Publisher

HerpClutch is published by OCG EBAYONG LLC.

1. Acceptance

You accept these Terms in the App, by selecting its acceptance control and continuing. HerpClutch records the version of the Terms you accepted. If you do not agree, do not continue into the App.

2. Eligibility

You must be legally capable of agreeing to these Terms. If you are not legally able to enter into a binding agreement in your jurisdiction, a parent or legal guardian must review and agree where permitted.

3. What HerpClutch Is

HerpClutch is a reptile record-management application that may help you organize:

  • Herps and species;
  • Clutches and parent Herps;
  • lay dates, egg counts, incubation periods, hatch windows and hatch status; and
  • photos, tags, notes, labels, QR codes, reminders and related records.

HerpClutch is a record-keeping tool. It is not veterinary, medical, legal, tax, genetics or professional breeding advice. Expected hatch dates and hatch windows are planning estimates. You remain responsible for animal-care, breeding, incubation and business decisions.

4. Your Account

You need a HerpClutch account to use the App. You are responsible for keeping your sign-in details secure. You can delete your account in the App at any time; see How to delete your HerpClutch account.

Deleting your HerpClutch account and canceling a subscription are separate actions. Deleting an account does not cancel, refund or modify a subscription purchased through an app store; cancel it through the store that sold it.

5. Your Records and Backups

You are responsible for the accuracy and legality of the information and photos you enter. HerpClutch stores your records and photos on your device, not on HerpClutch servers. Uninstalling the App, clearing its data, or resetting, replacing, losing or damaging your device may permanently remove them.

You are responsible for keeping backups of information you want to preserve. Create backups with Backup & Restore and save them outside the App, because a backup kept only inside the App may be removed with it. Backup files and other files you export or share are your responsibility; HerpClutch cannot reach or delete them. HerpClutch does not guarantee that device, platform, cloud or third-party backups will preserve or restore your HerpClutch information.

6. Plans and Paid Subscriptions

The features and usage limits available to you can vary by plan, and the App shows the limits that apply to your account. Archived records may continue to count toward a plan's limits, so limits cannot be bypassed by archiving.

HerpClutch may offer paid Premium subscriptions through the Apple App Store or Google Play. If it does and you buy one:

  • the plans, prices, billing periods, taxes and any trial or introductory offer are those the store shows you before purchase; these Terms do not fix a price;
  • a trial or introductory offer begins only when you start an eligible subscription through the store, and the store decides eligibility;
  • the subscription renews automatically unless you cancel, as shown by the store;
  • you manage and cancel it with Apple's or Google's subscription tools; canceling stops renewal, and Premium stays available until the end of the period you paid for;
  • uninstalling the App does not cancel a subscription;
  • where supported, you may restore eligible purchases, subject to the store's rules; and
  • payments, refunds and billing disputes follow the store's policies and applicable law.

If a subscription ends, HerpClutch will not delete your records solely because it ended. Your existing records stay accessible, but some features, including creating or changing records, may be restricted.

7. Archive and Permanent Delete

Archiving a Herp is not permanent deletion. Archived Herps may remain available for historical relationships and may remain counted toward plan limits. Permanent deletion may be blocked when a Herp is referenced by an existing Clutch or other protected breeding record. Permanent deletion cannot be undone.

8. Labels, QR Codes and Printing

HerpClutch can create Herp and Clutch labels, which may include a QR code that opens the record in the App. You can print through your device's print dialog or, where your device supports Brother Direct Print, directly to a supported Brother label printer on your local network. Printer availability, label media, print quality, Wi-Fi and third-party printer behavior depend on external hardware and platform services. A printer described as “recommended” is not guaranteed to work with every device or configuration. You are responsible for checking label content before you use a label.

9. Third-Party Services, Products and Links

HerpClutch relies on third-party services, including Firebase Authentication (Google) for sign-in, Google Sign-In and Sign in with Apple if you choose them, your device's operating system, and the Apple App Store and Google Play. Third-party products, purchases and websites are governed by the third party's own terms, privacy policy, warranty, return policy and pricing.

10. Acceptable Use

You agree not to:

  • use HerpClutch for unlawful activity;
  • attempt to defeat subscription enforcement or store billing;
  • reverse engineer, interfere with or misuse the App, except where applicable law expressly permits; or
  • use the App to violate another person's rights.

11. Intellectual Property

HerpClutch, its branding, software, designs and original content are owned by or licensed to OCG EBAYONG LLC, except for your records and third-party materials. Your records remain yours.

12. Changes to HerpClutch

We may update, modify, suspend or discontinue features as the App evolves. We may change plan features, usage limits or subscription pricing prospectively, subject to applicable store rules, notice requirements and law.

13. Ending Your Use and Deleting Your Account

You may stop using HerpClutch at any time, and you can delete your account in the App. Deleting your account permanently deletes your HerpClutch account and, on the device where you delete it, the records stored for it, as described in the Privacy Policy. It does not delete records on your other devices, files you exported or shared, files still in the App's temporary storage, or copies in your device or platform backups.

We may restrict access where necessary to enforce these Terms, store rules, security requirements or applicable law. A subscription ending does not, by itself, require deleting the records stored on your device.

14. Disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HERPCLUTCH IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

In particular, we do not guarantee that:

  • the App will always be available, or will operate without interruption or errors;
  • your data will be preserved permanently, or can always be recovered after device loss, corruption, reset or uninstall;
  • a backup will always restore successfully;
  • a printer, label medium or other third-party hardware will work with every device or configuration;
  • hatch-date estimates will predict the exact hatch date; or
  • reminders will be delivered in every device state.

Nothing in these Terms excludes or limits any warranty, right or remedy that cannot be excluded or limited under applicable law.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OCG EBAYONG LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR SIMILAR DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, HERPCLUTCH, INCLUDING ANIMAL LOSS, BREEDING OUTCOMES, LOST PROFITS, LOST RECORDS OR DEVICE AND HARDWARE ISSUES.

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.

16. Governing Law

These Terms are governed by the laws of the State of Ohio, United States, without regard to its conflict-of-law principles, subject to any mandatory consumer-protection or other statutory rights that cannot lawfully be waived or restricted.

17. Changes to These Terms

We may revise these Terms. This page shows the current version and its effective date. When the Terms change materially, the App may ask you to review and accept the new version before you continue.
